ஸ்ரீ சக்ரபுரி - ஸ்வாமி ஓம்கார்

இறையின்பம் திகட்டாத பேரின்பம் என்பது ஆன்மீகர்களின் அனுபவம். முழுமையான வாழ்வின் ஒரு நிமிடத்தின் புகைப்படம் எப்படி பல்வேறு கடந்தகால நிகழ்வை கிளர்ச்சியடைய செய்யுமோ அது போன்று ஒவ்வொரு கணமும் இறையனுபூதி பொழிந்தாலும் அதில் ஒரு கணத்தின் நிகழ்வை மட்டும் எடுத்துக்கொண்டு ரசிப்பது என்பது சுவாரசியமானது.

ஸ்ரீ சக்ரபுரி என்ற இந்த புத்தகம் இத்தகைய சுவாரசியம் வாய்ந்தது. தினம் தினம் நாம் பார்க்கும் ஒரு விஷயம் சாதாரணமாக தெரிந்தாலும் அதன் பின்னணியில் பெரும் ஆன்மீக சக்தி இருக்கலாம். அது போன்று திருவண்ணாமலை என்ற இடம் பலருக்கு சாராசரியான ஒரு வழிபாட்டு தலம். ஆனால் அது ஆன்மீக தேடல் கொண்டவருக்கு அள்ள அள்ள குறையாத ஆன்மீக சுரங்கம்.

ஞானப் பெருவெளியில் ஆன்மீகம் சுவைப்போர்க்கு மேலும் ஆழ்ந்த உணர்வூட்ட ஸ்வாமிஜியால் வெளிப்பட்டது ஸ்ரீ சக்ரபுரி. தன்னகத்தே பல்வேறு ஆன்மீகக் கருத்துகளை வைத்திருந்தாலும் அது பாமரனுக்கும் புரியச் செய்யும் ஆற்றல் சிலருக்கே உண்டு. ஸ்வாமி ஓம்கார் அவர்களின் விளக்கத்துடன் பயணிக்கும் பொழுது திருவண்ணாமலையின் ஒவ்வொரு சதுர அடியையும் ரசித்து மகிழலாம்.

இருத்தலின் பொருட்டு இடம் பெயர்ந்து நகரத்தின் பொய்முகங்களில் வாழ்வாதாரத்தைத் தேடியலைய நேரிடுகின்ற அவலச்சூழல் அச்சுறுத்துகின்ற ஒன்று. பச்சைப்பசேலெனப் புதர் மண்டிய கால்வாய்க்குள்ளாக தேங்காமல் ஓடும் அழுக்கு நீராக குற்ற உணர்ச்சி தருகிற துயரங்கள், அடைபட்டு வெளியேறும் நீரின் வேக வீச்சாய் எழுகின்ற நேசத்தின் உணர்வலைகள், நுரைத்து நுரைத்துப் பொங்கும் தீராக்காதலும், காமமும், தோத்தாங்கோழியாக்கி உக்கிர ஏளனத்தோடு பரிகசிக்கின்ற வாழ்க்கை குறித்த கேள்விகள் என அமிழ்ந்தமிழ்ந்து மேலெழும் பந்தாகி மிதந்து கொண்டிருக்கின்றன பெரியசாமியின் கவிதைகள்.

நிழல் விழக்கூட இடம்விடாமல் சுயம் பறிக்கும் சூது கொண்ட வாழ்வின் அன்றாடங்களில் பல்லியாகியும், ஏதிலியான கடவுளை நோக்கிக் கேள்வியெழுப்பியும், நினைவுகளைத் துழாவும் அன்றாட வாழ்வின் அபத்தங்களும் பெரியசாமியின் கவிதையின் உணர்வுகளாகின்றன. நகரமும், அதுகாட்டும் கோரமுகத்திற்குமிடையிலான நம் அக நினைவுகளை ஆசுவாசப்படுத்திக் கொள்ளச் செய்கின்றன இந்தக் கவிதைகள்.

நினைவுகள் சுமந்தலையும் யாத்ரீகன் - அபி மதியழகன்


வேளாண் குடும்பம் உருவாக்கிய மனநிலைக்கும் தொழில் நகரம் கட்டமைத்திருக்கும் மனநிலைக்கும் இடையிலான உராய்வின் விளைவானவை இவரின் கவிதைகள். உலக மயமாக்கல் என்ற மூன்றாம் உலக மனிதர்களுக்கு வாழ்வின் புதிய ருசிகளைக் காட்டி அந்நிலங்களுக்கு என்றிருந்த சிறந்த விழுமியங்களை அழித்து அவர்களை ஏகாதிபத்தி யங்களின் கூலிகளாக மாற்றி வைத்திருக்கிறது.  டாலர் பிச்சைக்காரர்களாகியிருப்பதை கௌரவமாக கருதும் ஒரு தலைமுறையை விமர்சனம் செய்வதாக இக்கவிதைகள் அமைந்திருக்கின்றன.

வேலையின் நிமித்தம் புலம் பெயர்தல், கிராமிய சமூகத்தின் சாதி இறுக்கம், கார்ப்பரேட்டுகள் உருவாக்கியிருக்கும் போலி நாகரிகம், பால்கவர்ச்சி, தமிழ்த்தேசிய சிக்கல்கள், ஏகாதிபத்திய ஒடுக்கு முறை என நம் சமூகம் எதிர்கொள்கிற எல்லா  சிக்கல்களும் மதியையும் அலைக்கழிக்கின்றன.    இத்தகைய நினைவலைகள் ஓயாமல் எழுப்பும் கேள்விகளை தன் கவிதை வழியாக நமக்கு ஆற்றுப்படுத்துகிறார் அபி மதியழகன்.

தர்மபுரி கலவரத்திற்கு பின்ணணி குழந்தைத் திருமணமா?


“சட்ட விரோத குழந்தைத் திருமணத்திற்கு இத்தனை பேர் வக்காலத்தா?” தலைப்பில் தர்மபுரி சாதிக் கலவரத்தைப் பற்றி தோழர் அருள் என்பவர் எழுதி இருந்தார்.

பள்ளி மாற்றுச் சான்றிதழ், மதிப்பெண் பட்டியல், சாதிச் சான்றிதழ் இவற்றை எல்லாம் ஆதாரமாக முன்வைத்து ‘இளவரசன்‘ என்ற அந்த தலித் இளைஞருக்கு 19 வயதுதான் ஆகிறது என்றும், அதனால் சட்டப்படி திருமணத்திற்கு உகந்த வயது அல்ல என்றும் தெரிவித்திருக்கிறார். அதுவுமல்லாமல், சட்ட விரோத குழந்தைத் திருமணத்திற்கு எல்லோரும் வக்காலத்து வாங்குவதாக குற்றம் சாட்டியிருந்தார்.

The Prohibition of Child Marriage Act, 2006,
Section 2 (a): "child" means a person who, if a male, has not completed twenty-one years of age, and if a female, has not completed eighteen years of age.

வாழ்க்கைத் துணையை தேர்ந்தெடுக்கிற அளவுக்கு பக்குவமற்ற வயது என்பதால் இதை தவிர்க்க வேண்டும் என்ற நோக்கத்திலும், அறிவியல் ரீதியாக உடல் நலம் சார்ந்து தகுதியடைய வேண்டும் என்ற நல்லெண்ணத்திலும், இப்படியான திருமணங்கள் தவிர்க்கப்பட வேண்டும் என்பதற்காகவே இந்தச் சட்டம் இயற்றப்பட்டது.

உண்மையில் தர்மபுரி சாதிக் கலவரத்திற்கு காரணமான திருமணத்தில் குழந்தைத் திருமண தடைச்சட்டம் பிரயோகிக்க பொருந்தக் கூடியதல்ல. நடந்து முடிந்து விட்ட ஒரு திருமணத்தைப் பொறுத்த வரையில் திருமணத்தில் சம்பந்தப்பட்ட இருவரும் இந்துக்கள் என்பதால், இந்து திருமணச் சட்டம் 1955 மட்டுமே பொருந்தத்தக்கது. மேற்படி திருமணம் செல்லத் தக்கதா, தவிர்த்தகு திருமணமா, செல்லா நிலையதா என்பதை இந்து திருமணச் சட்டத்தின் வாயிலாகவே நிலை நிறுத்த முடியும்.

இந்து திருமணத்திற்கான ஐந்து கட்டாய அம்சங்களை இந்து திருமணச் சட்டம் வரையறுத்துள்ளது. அதற்குட்பட்டே இந்து திருமணங்கள் நடைபெற வேண்டும். அதில் முக்கியமான ஒன்று வயதைப் பற்றியது.

The Hindu Marriage Act, 1955 Section 5 (iii) the bridegroom has completed the age of eighteen years and the bride, the age of fifteen years at the time of marriage.

அதாவது ஆணுக்கு 18 வயதும், பெண்ணுக்கு 15 வயதும் நிறைவு பெற்றிருக்க வேண்டும். இந்த சட்டம் 1.10.78 ல், ஆணுக்கு 21 வயது என்றும், பெண்ணுக்கு 18 வயது என்றும் திருத்தம் செய்யப்பட்டது.

ஆக இந்து திருமண சட்டத்தின்படி ஆணுக்கு 21 வயதும், பெண்ணுக்கு 18 வயதும் ஆகியிருக்க வேண்டும் என்பது கட்டாயம்தான். அதே சமயம்
மேற்குறிப்பிட்ட வயதுக்குள்ளாக இருக்கும் இருவர் திருமணம் செய்து கொண்டால் அது செல்லத்தகாத திருமணமா என்றால் இல்லை என்கிறது அதே இந்து திருமண சட்டம், 1955, பிரிவு 13 (2) (iv).

இந்து திருமண சட்டம், 1955, பிரிவு 13 என்பது விவாகரத்துக்கானது.
The Hindu Marriage Act, 1955
Section 13 (2) (iv) that her marriage (whether consummated or not) was solemnized before she attained the age of fifteen years and she has repudiated the marriage after attaining that age but before attaining the age of eighteen years.

உரிய வயதுக்கு முன்பாக ஒரு திருமணம் நடைபெற்று விட்டால் அந்த திருமணம் செல்லத் தகாதது அல்ல என்றாகி விடாது. இந்து திருமணச் சட்டத்தின் பிரிவு 5 (iii) ல் வயது திருத்தம் செய்யப்பட்டது. ஆனால், பிரிவு 13(2) (iv) என்பதில் சட்டத் திருத்தம் செய்யப்படவில்லை.

இந்த வயதுடையவர்கள் திருமணம் செய்து கொள்ளத் தகுதியானவர்கள் என்பது வரையறுக்கப்பட்டது. அப்படி செய்து கொண்டால் அது செல்லத் தக்கதா, செல்லத் தகாததா என்றால்.. செல்லத்தக்க திருமணம்தான் என்கிறது சட்டம். அப்படி மணம் செய்து கொண்டவர்கள் உரிய வயதை அடையும் போது, அந்த திருமணத்தை தொடரலாமா, ரத்து செய்யலாமா என்ற முடிவை எடுக்கிற உரிமை உண்டு.

மாண்பமை நீதிபதி நாகமுத்து தலைமையிலான முழு அமர்வு T.Sivakumar vs The Inspector of Police, Thiruvallur Town Police Station and others என்ற வழக்கிலும், V.Premakumari vs M.Palani என்ற வழக்கில் மாண்பமை நீதிபதி அக்பர் அலி அவர்களாலும் என இரண்டு முக்கிய வழக்குகளில் இதற்கான தீர்ப்பை சென்னை உயர் நீதி மன்றம் வழங்கியிருக்கிறது.

மேற்படி இரண்டு வழக்குகளுமே, Prohibition of Child Marriage Act, 2006 பிரிவு 2 (e) & 3 ஆகியவற்றின் கீழ் உரிய வயதடையாததால் திருமணத்தை ரத்து செய்யக் கோரியும், தண்டனைக்குரிய குற்றம் எனவும் தொடரப்பட்ட வழக்குகள் என்பது முக்கியமானது.

தர்மபுரியில் நடைபெற்ற கலவரத்திற்கு முழுக்க முழுக்க காரணம் சாதி வெறியும், அதையொட்டிய முன் விரோதமும்தான். இதை எத்தனை விதமாக பூசி மெழுகினாலும், உண்மை இதுதான்.

தகவல் தொழில் நுட்ப சட்டமும், நெறிக்கப்படும் குரல்வளையும்


தகவல் தொழில் நுட்ப சட்டம் 2008 ரொம்ப விரிவானது. சமூக வலைத்தளம் சார்ந்த குற்றங்களுக்கானது மட்டுமில்லை. தானியங்கி பணம் அளிக்கும் இயந்திரங்கள், வலைத்தள தகவல் திருட்டு, காப்புரிமை இதெல்லாமும் சேர்ந்தது. இணைய தளத்தில் தவறான, அவதூறான தகவல்களை பதிவதைப் பற்றியதுதான் 66 பிரிவு. இந்த சட்டத்தின் 66 முதல் 69 வரையிலான எல்லா பிரிவுகளிலும் இணைய தளம் சார்ந்த குற்றங்களை விரிவாக எடுத்துரைக்கப்பட்டுள்ளது.

2009 ல் குடியரசுத் தலைவர் தகவல் தொழில் நுட்ப  சட்ட திருத்தத்திற்கு அனுமதி  அளித்துள்ளார். இது, இந்திய அரசியலமைப்புச்  சட்டம் உறுதி செய்துள்ள குடி மக்களின் தனி நபர் உரிமைக்கு உலை வைக்கும் சட்டம்.

திருத்தச் சட்டத்தின் 69(1) பிரிவு மற்றும் 69(2) பிரிவு மத்திய அரசு, மாநில அரசு அல்லது அதன் அதிகாரிகள் இதற்கென சிறப்பாக அதிகாரம் அளிக்கப்பட்டு அவர்களின் விருப்ப அதிகாரத்திற்கு உட்பட்டு, இந்திய அரசின் இறையாண்மை அல்லது ஒருமைப்பாடு, பாதுகாப்பு , நட்பு நாடுகளின் நலன்கள் அல்லது பொது ஒழுங்கு ஆகியவற்றை காத்திட, மேற்குறித்தவைகள் மீது உடனடி நடவடிக்கை மேற்கொள்ளக் கூடிய குற்றம் ஏதேனும் இழைப்பதை தடுத்திட, அக்குற்றங்கள் குறித்து புலன் ஆய்வு ஏதேனும் மேற்கொள்ள, எழுத்து மூலம் காரணங்கள் பதிவு செய்து, எந்த ஒரு அரசாங்கத்தையோ அல்லது ஒரு முகவாண்மையையோ, கணினி வழியாக அனுப்பப்படும் எந்த ஒரு தகவலையோ,கணினியில் காத்து வைக்கப்படும் தகவலையோ, இடையீடு செய்து கண்காணிக்க, மறித்திட, உத்தரவு அளித்து செயல்பட முடியும். இவ்வகை செயல்பாட்டிற்கு உகந்த வழிமுறைகள் ஏற்படுத்தப்பட வேண்டும் எனவும் குறிப்பிடப் பட்டுள்ளது.

இதன்படி, காவல்துறைக்கு எல்லைமீறிய அதிகாரத்தை இச்சட்டம் அளிக்கிறது. அரசாங்கங்கள் உங்களின் மின்னஞ்சல்,குறுந்தகவல்,தொலைபேசி உரையாடல் போன்ற, அனைத்து தகவல் தொடர்பு நடவடிக்கைகளையும், கண்காணித்திட முடியும். நீதிமன்ற உத்தரவு ஏதும் இல்லமாலே, காவல்துறை ஆய்வாளர்  ஒருவர், ஒரு இல்லத்தில் நுழைந்து தேடுதல் நடவடிக்கை செய்திட முடியும், கணினியை கைப்பற்ற முடியும், புலன் விசாரணை நடவடிக்கையில் ஈடுபடமுடியும்.

முன்னர், இந்திய தொலைத் தொடர்பு சட்டம், 1885ன் கீழ், பொது பாதுகாப்பு நலன்கள் சம்பந்தமாக அரசாங்கம், முறையற்ற முறையில் தகவல்கள் பரிமாற்றம் மற்றும் அதனை இடை மறிப்பு செய்வது குறித்து, எச்சரிக்கை ஏற்பாடுகள் உருவாக்க வேண்டும் என விதிக்கப்பட்டுள்ளது.

ஆனால், இதுநாள் வரையில் எந்த அரசாங்கமும் எவ்வித நடைமுறையும் உருவாக்கிட அக்கறை காட்டவில்லை. காரணம், அனைத்து அரசும், எதிர்க் கட்சிகள் தகவல்களை ஒற்றாடுவது, இயன்றால் குடிமக்களின் தகவல் பரிமாற்றங்களையும் வேவு செய்வது போன்ற செயல்களை தொடர்ந்து நிகழ்த்துகிறது.

1996ல் மக்கள் சிவில் உரிமைக் கழகம் உச்சநீதி மன்றத்தில் தொடர்ந்த வழக்கில் அளித்த தீர்ப்பில், 1885ஆம் ஆண்டு தொலைத் தொடர்பு சட்டத்தை பயன்படுத்தும் போது அரசாங்கம் கடை பிடிக்க வேண்டிய சில நெறிமுறைகளை வகுத்தது. இவ்வாறு, முதன்முறையாக ஒரு ஒழுங்கை அரசாங்கம் தொலைபேசி ஒட்டு கேட்பதில் அமுல்படுத்த உச்ச நீதி மன்றம் வலியுறுத்தியது.

மேலும், நாட்டின் இறையாண்மை,பாதுகாப்பு, ஒருமைப்பாடு மற்றும் அந்நிய நாடுகளின் உறவு தொடர்பான பிரச்சினைகளில் மட்டும் அதிகாரத்தை பயன்படுத்த வேண்டும் என சுட்டியது.பொது ஒழுங்கு நிலை நாட்ட, ஒரு குற்றம் இழைக்க தூண்டுவது போன்ற நேர்வுகளிலும் ஒட்டு கேட்கும் அதிகாரம் செல்லுபடியாகும் என்றது.

எனினும்,ஒட்டு கேட்பது தொடர்பாக மத்திய அரசின் உள்துறை செயலர் அல்லது மாநில அரசின் உள்துறை செயலர் எழுத்து மூலம் ஒரு உத்தரவு பிறப்பிக்க வேண்டும் அதில் எவ்வகையான தகவல் ஒட்டு கேட்கப்படவேண்டும் என்பதும் தெளிவாக குறிக்கப்பட வேண்டும் எனவும் தெளிவாக்கப் பட்டுள்ளது.

இதற்கும் மேலாக, நீதி மன்றம் இவ் உத்தரவு சம்பந்தமாக மீள் பார்வை குழு ஒன்றும், அமைச்சரவை அலுவலக செயலர், சட்டத் துறை செயலர், மற்றும் தகவல் தொடர்பு செயலர் ஆகியோரை உள்ளடக்கி மத்திய அரசு மட்டத்திலும், இணையாக மாநில அரசு மட்டத்திலும் அமைக்கப்பட்டு சட்டத்தை மீறிய செயல்பாட்டு உத்தரவை ரத்து செய்து, இடை மறித்து எடுக்கப்பட்ட தகவல்களை அழித்துவிடலாம் எனவும் அதிகாரம் அளிக்கப்பட்டுள்ளது.

புதிதாக உருவாக்கப்பட்டுள்ள சட்டத்தில் இவ்வகையான பாதுகாப்பு அம்சங்கள் ஏதும் இல்லை.தகவல் தொழில் நுட்ப (திருத்த) சட்டத்தில் இவ்வகை நடைமுறை, பாதுகாப்பு அம்சங்கள் ஏற்படுத்துவது குறித்து இடம் பெற்றிருந்தாலும் தற்போது அரசாங்கம் இதற்கான ஒழுங்கு முறைகளை உருவாக்கும் என்று தோன்றவில்லை.

அவ்வாறு எண்ணம் இருந்திருப்பின், அசல் சட்டத்திலேயே அதற்கு உரிய அம்சங்களை சேர்த்து சட்டத்தை உருவாக்கி இருக்க முடியும்.ஆங்கிலேயர் இயற்றிய சட்டத்திலேயே இது போன்ற பாதுகாப்பு அம்சங்களை உருவாக்காத அரசாங்கம், 60 ஆண்டுகள் கழித்து உச்ச நீதி மன்றம் தலையிடும் வரை செயலற்றுக் கிடந்த அரசாங்கம் தற்போது மக்கள் பேச்சு உரிமை , கருத்து உரிமை காத்திட முனையும் என்பதில் நம்பிக்கை இல்லை.

பாதுகாப்பு அம்சங்கள் ஏதும் இல்லாத இச்சட்டம் மக்களின் தகவல் பரிமாற்றத்தை அவர்கள் அறியாமலே அவர்கள் எங்கு சென்றாலும் தொடர்ந்து கண்காணித்திடும்.சட்டம் இயற்றப்படுவதற்கு முன்பே ஓர் அறிக்கையில் 'மின்னணு காவல் அரசு' என்னும் தலைப்பில்,52 நாடுகளின் ஆய்வில் இந்தியா 20வது இடத்தை பிடித்துள்ளது.பிற நாடுகளில் சில,சீனா,வட கொரியா, ரஷ்யா, சிங்கப்பூர் ஆகியன.

குறிப்பாக இச்சட்டம் என்பது குடி மக்களின் அடிப்படை உரிமைகளான பேச்சுரிமை, எழுத்துரிமை, கருத்துரிமை ஆகியவற்றை நசுக்கவும் நஞ்சு அளித்திடவும் செய்கிற சட்டம். பொறுப்பற்ற காவல்துறையின் கைககளில் இது இந்தியாவை,'1984ஆம் ஆண்டு ஆர்வெலியன் தேசமா' மாற்றி விடும்.

IT Act Section 66 to 69
Sec 66. Computer Related Offences
If any person, dishonestly, or fraudulently, does any act referred to in section 43, he shall be punishable with imprisonment for a term which may extend to three years or with fine which may extend to five lakh rupees or with both.
Explanation: For the purpose of this section,-
a) the word “dishonestly” shall have the meaning assigned to it in section 24 of the
Indian Penal Code;
b) the word “fraudulently” shall have the meaning assigned to it in section 25 of
the Indian Penal Code.
66 A Punishment for sending offensive messages through communication service, etc
Any person who sends, by means of a computer resource or a communication device,-
a) any information that is grossly offensive or has menacing character; or
b) any information which he knows to be false, but for the purpose of causing annoyance, inconvenience, danger, obstruction, insult, injury, criminal intimidation, enmity, hatred, or ill will, persistently makes by making use of such computer resource or a communication device,
c) any electronic mail or electronic mail message for the purpose of causing annoyance or inconvenience or to deceive or to mislead the addressee or recipient about the origin of such messages shall be punishable with imprisonment for a term which may extend to three years and with fine.
Explanation: For the purposes of this section, terms “Electronic mail” and “Electronic Mail Message” means a message or information created or transmitted or received on a computer, computer system, computer resource or communication device including attachments in text, image, audio, video and any other electronic record, which may be transmitted with the message.
66 B. Punishment for dishonestly receiving stolen computer resource or communication device
Whoever dishonestly receives or retains any stolen computer resource or communication device knowing or having reason to believe the same to be stolen computer resource or communication device, shall be punished with imprisonment of either description for a term which may extend to three years or with fine which may extend to rupees one lakh or with both.
66C Punishment for identity theft
Whoever, fraudulently or dishonestly make use of the electronic signature, password or any other unique identification feature of any other person, shall be punished with imprisonment of either description for a term which may extend to three years and shall also be liable to fine which may extend to rupees one lakh.
66D Punishment for cheating by personation by using computer resource
Whoever, by means of any communication device or computer resource cheats by personation, shall be punished with imprisonment of either description for a term which may extend to three years and shall also be liable to fine which may extend to one lakh rupees.
66E Punishment for violation of privacy
Whoever, intentionally or knowingly captures, publishes or transmits the image of a private area of any person without his or her consent, under circumstances violating the privacy of that person, shall be punished with imprisonment which may extend to three years or with fine not exceeding two lakh rupees, or with both Explanation.- For the purposes of this section–
(a) “transmit” means to electronically send a visual image with the intent that it be viewed by a person or persons;
(b) “capture”, with respect to an image, means to videotape, photograph, film or record by any means;
(c) “private area” means the naked or undergarment clad genitals, pubic area, buttocks or female breast;
(d) “publishes” means reproduction in the printed or electronic form and making it available for public;
(e) “under circumstances violating privacy” means circumstances in which a person can have a reasonable expectation that–
(i) he or she could disrobe in privacy, without being concerned that an image of his private area was being captured; or
(ii) any part of his or her private area would not be visible to the public, regardless of whether that person is in a public or private place.
66F. Punishment for cyber terrorism
(1) Whoever,-
(A) with intent to threaten the unity, integrity, security or sovereignty of India or to strike terror in the people or any section of the people by –
(i) denying or cause the denial of access to any person authorized to access computer resource; or
(ii) attempting to penetrate or access a computer resource without authorisation or exceeding authorized access; or
(iii) introducing or causing to introduce any Computer Contaminant. and by means of such conduct causes or is likely to cause death or injuries to persons or damage to or destruction of property or disrupts or knowing that it is likely to cause damage or disruption of supplies or services essential to the life of the community or adversely affect the critical information infrastructure specified under section 70, or
(B) knowingly or intentionally penetrates or accesses a computer resource without authorisation or exceeding authorized access, and by means of such conduct obtains access to information, data or computer database that is restricted for reasons of the security of the State or foreign relations; or any restricted information, data or computer database, with reasons to believe that such information, data or computer database so obtained may be used to cause or likely to cause injury to the interests of the sovereignty and integrity of India, the security of the State, friendly relations with foreign States, public order, decency or morality, or in relation to contempt of court, defamation or incitement to an offence, or to the advantage of any foreign nation, group of individuals or otherwise, commits the offence of cyber terrorism.
(2) Whoever commits or conspires to commit cyber terrorism shall be punishable with imprisonment which may extend to imprisonment for life’.
67. Punishment for publishing or transmitting obscene material in electronic form
Whoever publishes or transmits or causes to be published in the electronic form, any material which is lascivious or appeals to the prurient interest or if its effect is such as to tend to deprave and corrupt persons who are likely, having regard to all relevant circumstances, to read, see or hear the matter contained or embodied in it, shall be punished on first conviction with imprisonment of either description for a term which may extend to three years and with fine which may extend to five lakh rupees and in the event of a second or subsequent conviction with imprisonment of either description for a term which may extend to five years and also with fine which may extend to ten lakh rupees.
67 A Punishment for publishing or transmitting of material containing sexually explicit act, etc. in electronic form
Whoever publishes or transmits or causes to be published or transmitted in the electronic form any material which contains sexually explicit act or conduct shall be punished on first conviction with imprisonment of either description for a term which may extend to five years and with fine which may extend to ten lakh rupees and in the event of second or subsequent conviction with imprisonment of either description for a term which may extend to seven years and also with fine which may extend to ten lakh rupees.
Exception: This section and section 67 does not extend to any book, pamphlet, paper, writing, drawing, painting, representation or figure in electronic form-
(i) the publication of which is proved to be justified as being for the public good on the ground that such book, pamphlet, paper, writing, drawing, painting, representation or figure is in the interest of science,literature,art,or learning or other objects of general concern; or
(ii) which is kept or used bona fide for religious purposes.
67 B Punishment for publishing or transmitting of material depicting children in sexually explicit act, etc. in electronic form
Whoever,-
(a) publishes or transmits or causes to be published or transmitted material in any electronic form which depicts children engaged in sexually explicit act or conduct or
(b) creates text or digital images, collects, seeks, browses, downloads, advertises, promotes, exchanges or distributes material in any electronic form depicting children in obscene or indecent or sexually explicit manner or
(c) cultivates, entices or induces children to online relationship with one or more hildren for and on sexually explicit act or in a manner that may offend a reasonable adult on the computer resource or
(d) facilitates abusing children online or
(e) records in any electronic form own abuse or that of others pertaining to sexually explicit act with children, shall be punished on first conviction with imprisonment of either description for a term which may extend to five years and with a fine which may extend to ten lakh rupees and in the event of second or subsequent conviction with imprisonment of either description for a term which may extend to seven years and also with fine which may extend to ten lakh rupees: Provided that the provisions of section 67, section 67A and this section does not extend to any book, pamphlet, paper, writing, drawing, painting, representation or figure in electronic form-
(i) The publication of which is proved to be justified as being for the public good on the ground that such book, pamphlet, paper writing, drawing, painting, representation or figure is in the interest of science, literature, art or learning or other objects of general concern; or
(ii) which is kept or used for bonafide heritage or religious purposes
Explanation: For the purposes of this section, “children” means a person who has not completed the age of 18 years.
67 C. Preservation and Retention of information by intermediaries
(1) Intermediary shall preserve and retain such information as may be specified for such duration and in such manner and format as the Central Government may prescribe.
(2) Any intermediary who intentionally or knowingly contravenes the provisions of sub section (1) shall be punished with an imprisonment for a term which may extend to three years and shall also be liable to fine.
68. Power of Controller to give directions
(1) The Controller may, by order, direct a Certifying Authority or any employee of such Authority to take such measures or cease carrying on such activities as specified in the order if those are necessary to ensure compliance with the provisions of this Act, rules or any regulations made there under.
(2) Any person who intentionally or knowingly fails to comply with any order under sub-section (1) shall be guilty of an offence and shall be liable on conviction to imprisonment for a term not exceeding two years or to a fine not exceeding one lakh rupees or to both.
Sec 69. Powers to issue directions for interception or monitoring or decryption of any information through any computer resource
(1) Where the central Government or a State Government or any of its officer specially authorized by the Central Government or the State Government, as the case may be, in this behalf may, if is satisfied that it is necessary or expedient to do in the interest of the sovereignty or integrity of India, defense of India, security of the State, friendly relations with foreign States or public order or for preventing incitement to the commission of any cognizable offence relating to above or for investigation of any offence, it may, subject to the provisions of sub-section (2), for reasons to be recorded in writing, by order, direct any agency of the appropriate Government to intercept, monitor or decrypt or cause to be intercepted or monitored or decrypted any information transmitted received or stored through any computer resource.
(2) The Procedure and safeguards subject to which such interception or monitoring or decryption may be carried out, shall be such as may be prescribed
(3) The subscriber or intermediary or any person in charge of the computer resource shall, when called upon by any agency which has been directed under sub section (1), extend all facilities and technical assistance to -
(a) provide access to or secure access to the computer resource containing such information; generating, transmitting, receiving or storing such information; or
(b) intercept or monitor or decrypt the information, as the case may be; or
(c) provide information stored in computer resource.
(4) The subscriber or intermediary or any person who fails to assist the agency referred to in sub-section (3) shall be punished with an imprisonment for a term which may extend to seven years and shall also be liable to fine.
Sec 69 A Power to issue directions for blocking for public access of any information through any computer resource
(1) Where the Central Government or any of its officer specially authorized by it in this behalf is satisfied that it is necessary or expedient so to do in the interest of sovereignty and integrity of India, defense of India, security of the State, friendly relations with foreign states or public order or for preventing incitement to the commission of any cognizable offence relating to above, it may subject to the provisions of sub-sections (2) for reasons to be recorded in writing, by order direct any agency of the Government or intermediary to block access by the public or cause to be blocked for access by public any information generated, transmitted, received, stored or hosted in any computer resource.
(2) The procedure and safeguards subject to which such blocking for access by the public may be carried out shall be such as may be prescribed.
(3) The intermediary who fails to comply with the direction issued under sub- section (1) shall be punished with an imprisonment for a term which may extend to seven years and also be liable to fine.
Sec 69B Power to authorize to monitor and collect traffic data or information through any computer resource for Cyber Security
(1) The Central Government may, to enhance Cyber Security and for identification, analysis and prevention of any intrusion or spread of computer contaminant in the country, by notification in the official Gazette, authorize any agency of the Government to monitor and collect traffic data or information generated, transmitted, received or stored in any computer resource.
(2) The Intermediary or any person in-charge of the Computer resource shall when called upon by the agency which has been authorized under sub-section (1), provide technical assistance and extend all facilities to such agency to enable online access or to secure and provide online access to the computer resource generating , transmitting, receiving or storing such traffic data or information.
(3) The procedure and safeguards for monitoring and collecting traffic data or information, shall be such as may be prescribed.
(4) Any intermediary who intentionally or knowingly contravenes the provisions of sub-section (2) shall be punished with an imprisonment for a term which may extend to three years and shall also be liable to fine.
Explanation: For the purposes of this section,
(i) “Computer Contaminant” shall have the meaning assigned to it in section 43
(ii) “traffic data” means any data identifying or purporting to identify any person, computer system or computer network or location to or from which the communication is or may be transmitted and includes communications origin, destination, route, time, date, size, duration or type of underlying service or any other information.
